OFFICIAL RULES
1. DESCRIPTION: "My Journey, My Story" Share Your Experience (hereafter called "Submissions") is being held to encourage Vietnamese Americans and Vietnam Veterans to share the story of their own personal journey from Vietnam to America. ImaginAsian Pictures ("IAP") is looking for video clips of up to five (5) minutes in length, in conjunction with the release of the feature film, "Journey from the Fall". The selected submissions will have their videos included in Journey from the Fall DVD (Special Features section). Submit a video of yourself, your friend, or family member narrating a personal story of leaving Vietnam and coming to America after the fall of Saigon and the following years. Those selected will receive a free copy of the DVD.
2. TO SUBMIT. To submit, you must visit www.JourneyfromtheFall.com and complete the following steps: (a) Read and agree with these Official Rules – Submission of a video confirms your agreement with these Official Rules; (b) download, sign and complete "My Journey, My Story" Submission Form and included it with your video submission to be eligible. (The Entry Form must include your current address and telephone number); (c) All submissions must be submitted on DVD, Mini DV, DV Cam, DVC Pro, Beta SP, or Digi Beta format. Please send a copy and NOT your Master; and (d) Send your completed "My Journey, My Story" Submission Form along with your video submission to the following address:

The selection of video will be determined by the judges selected by ImaginAsian Pictures in their sole discretion, and in accordance with these Official Rules.
3. ELIGIBILITY: This Call for Submission is open to all individuals who submit original videos that they have personally created. Any Participant under the age of 18 must have parents or guardians’ consent signature on the Submission Form. This call for submission is void where prohibited by law, or where the registration or filing requirements of any state or local jurisdictions have not been complied with. This call for submission is not open to employees of ImaginAsian Entertainment, Inc, ImaginAsian Pictures, subsidiaries and affiliates, including their immediate families.
4. VIDEO SUBMISSION REQUIREMENTS. Each person submitting a video must create his or her own "My Journey, My Story" video. Participants may use any visual medium to create the video, including without limitation, film, animation and digital photography. All footage must be originally created material. No unauthorized use of copyrighted property from any other film or composition may be used. The video cannot contain any commercial endorsements. No nudity, profanity or extreme violence is allowed. The foregoing requirements/restrictions will be strictly enforced and any submissions that do not, in sponsor’s sole discretion, comply with all of the foregoing requirements will be disqualified. All submitted videos become the property of ImaginAsian Pictures and will not be returned.
5. SUBMISSION DEADLINE. The acceptance of submission begins on February 15, 2007 and ends on April 30, 2007. ("Submission Period").
6. RIGHT TO DISPLAY VIDEO SUBMISSION. Each participant agrees and grants IAP permission to make available and display/perform and otherwise distribute participant’s name and video submission in all media in perpetuity without compensation. In addition, participant agrees that if their submission is selected it may be included in the release of Journey from the Fall DVD (Special Features section) without further compensation. Except where legally prohibited, submission of a video constitutes permission for IAP to use the participant’s name, photograph, likeness, voice, address (city and state) and testimonials, in printed, broadcast media or new media, in perpetuity, in any manner IAP deems appropriate in connection with promoting the video submission itself or the release of Journey from the Fall DVD, without further compensation.
7. SELECTION PROCESS: ImaginAsian Pictures will select 2-3 videos at the end of the Call for Submission Period. Each video will be selected by IAP and Journey from the Fall producers and director. Decisions of judges are final and binding. Once selected, participants will be notified by email and or phone and or mail at IAP’s sole discretion.
8. CONDITIONS OF PARTICIPATION. IAP reserves the right not to include the selected videos in Journey from the Fall DVD at its absolute sole discretion. There is no warranty of any kind from IAP, express or implied, without limitation, except where this would be contrary to federal, state, provincial, or local law or regulation. All federal, state, provincial and local laws and regulations apply. Submission of video by a participant deems that participant agrees to be bound by the terms of these Official Rules and by the decisions of IAP, which are final and binding on all matters pertaining to this Call for Submissions. Selected participants may be required to sign and return a Declaration of Eligibility/Liability & Publicity Release within 30 days following the date of first attempted notification. Failure to comply within this time period may result in disqualification and selection of an alternate. The intellectual and industrial property rights to the submitted materials, if any, will remain with the participants, except that these terms do not supersede any other assignment or grant of rights according to any other separate agreements between participants and other parties. As a condition of submission, participants agree that ImaginAsian Pictures shall have the right to use, copy, modify and make available the video in connection with the operation, conduct, administration, advertising and promotion of the call for Submission via communication to the public, including, but not limited to the right to make screenshots, animations and video clips available to the public for promotional and publicity purposes. Notwithstanding the foregoing, ownership of and all intellectual and industrial property rights in and to the video shall remain with the participant. Acceptance of the free DVD constitutes permission for, and winners consent to, its agencies to use a winner's name and/or likeness and entry for advertising and promotional purposes without additional compensation, unless prohibited by law. To the extent permitted by law, participants agree to hold IAP, its parent, subsidiaries, agents, directors, officers, employees, representatives and assigns harmless from any injury or damage caused or claimed to be caused by participation in or use or acceptance of any prize won, except to the extent that any death or personal injury is caused by the negligence of IAP. A participant may be prohibited from participating if, in IAP's sole discretion, it reasonably believes that the participant has attempted to undermine the legitimate operation of this Call for Submission by deception, or other unfair playing practices or annoys, abuses, threatens or harasses any other participants, IAP or associated companies and agencies.
9. NO RECOURSE TO JUDICIAL OR OTHER PROCEDURES: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Call for Submissions are hereby excluded, and any participant expressly waives any and all such rights. Participants agree that these Official Rules are governed by the laws of the state of New York, USA.
10. DATA PRIVACY & COPPA: Participants agree that personal data, especially name and address, may be processed, stored and otherwise used for the purposes and within the context of this Call for Submission and any other purposes outlined in these Official Rules. The data may also be used by IAP in order to check participants' identity, their postal address and telephone number, or to send and to receive any notice. If participant's data is not provided on the submission form, the participants' submission will be ineligible. In compliance with the Children’s Online Privacy Protection Act ("COPPA"), any Participant under the age of 18 must have the consent of parents and guardians to enter this call for submissions. IAP will not accept submission from any Participant without a proper written consent evidenced in the Submission Form.
11. WARRANTY AND INDEMNITY: Each participant certifies that his or her entry is original and that he or she is the sole and exclusive owner and right holder of the submitted video, and that they have the right to submit the video. Each participant agrees not to submit any material that (1) infringes any 3rd party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (2) otherwise violates applicable law in any countries in the world. To the maximum extent permitted by law, each participant indemnifies and agrees to keep indemnified IAP, its parent, subsidiaries, agents, directors, officers, employees, representatives and assigns harmless at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the participant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each participant indemnifies and agrees to keep indemnified IAP, its parent, subsidiaries, agents, directors, officers, employees, representatives and assigns harmless at all times from and against any liability, actions, claims, demands, losses, damages, costs and expenses for or in respect of which IAP will or may become liable by reason of or related or incidental to any act, default or omission by a participant under these Official Rules including without limitation resulting from or in relation to any breach, non-observance, act or omission whether negligent or otherwise, pursuant to these official rules by a participant.
12. ELIMINATION: Any false information provided within the context of the Call for Submission by any participant concerning identity, postal address, telephone number, ownership of right or non-compliance with these rules or the like may result in the immediate elimination of the participant from consideration by the judges. IAP further reserves the right to disqualify any submission that it believes in its sole and unfettered discretion infringes upon or violates the rights of any third party or otherwise does not comply with these official rules.
13. If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
